These Terms of Use (“Terms”) govern your access to and use of the website, tenant portal, and related online services (collectively, the “Site”) operated by DPG Investments and White Rose Homes, LLC (“DPG Investments and White Rose Homes,” “we,” “us,” or “our”).
The Site includes both publicly accessible portions, including listings of homes available for rent, and password-protected portions through which current and prospective tenants and other authorized users may access lease documents, make payments, submit maintenance requests, communicate with DPG Investments or White Rose Homes, and use other property-management services.
Please read these Terms carefully. By accessing or using the Site, creating an account, submitting information through the Site, or otherwise using the services available through the Site, you acknowledge that you have read, understand, and agree to be bound by these Terms.
If you do not agree to these Terms, you should not use the Site.
IMPORTANT: THE SITE IS PROVIDED AS A CONVENIENCE. THESE TERMS DO NOT REPLACE, AMEND, OR SUPERSEDE YOUR LEASE. IF THERE IS A CONFLICT BETWEEN THESE TERMS OR INFORMATION DISPLAYED ON THE SITE AND THE TERMS OF AN EXECUTED LEASE, THE LEASE CONTROLS, EXCEPT WITH RESPECT TO MATTERS RELATING SOLELY TO USE OR OPERATION OF THE SITE.
The Site is intended to provide information regarding residential rental properties owned or managed by DPG Investments or White Rose Homes and to facilitate certain interactions between DPG Investments or White Rose Homes and current or prospective tenants, occupants, guarantors, and other authorized users.

You may use the Site only for lawful purposes and in connection with a legitimate rental inquiry, application, tenancy, guaranty, or other authorized relationship with DPG Investments or White Rose Homes.
By using the Site, you represent that you are legally capable of entering into these Terms. If you use the Site on behalf of another person or legal entity, you represent that you are authorized to act on that person’s or entity’s behalf with respect to your use of the Site.
Certain features of the Site may require you to establish an account (“Account”).
You agree to provide accurate, complete, and current information when establishing and using your Account and to promptly update information that changes.
DPG Investments and White Rose Homes may rely on information provided through your Account unless and until we receive notice that the information is inaccurate or the Account has been compromised.
You may not create an Account using another person’s identity or provide false or misleading information.
You are responsible for maintaining the confidentiality of your username, password, and other login credentials.

DPG Investments or White Rose Homes may treat activity conducted through authenticated login credentials as activity authorized by the Account holder unless DPG Investments or White Rose Homes has received notice that the Account or credentials may have been compromised.
The Site is provided as a convenience and may not be available at all times.
Access may be interrupted because of scheduled or emergency maintenance, internet or telecommunications failures, software or hardware problems, cybersecurity events, third- party service interruptions, or circumstances beyond the reasonable control of DPG Investments and White Rose Homes.
The temporary unavailability of the Site does not excuse or extend any obligation imposed by a Lease or applicable law, including an obligation to timely pay rent or deliver a notice by a legally required method.
If the Site is unavailable, users should use another method of communication or payment permitted by their Lease or otherwise made available by DPG Investments or White Rose Homes.
The Site may permit users to electronically pay rent, security deposits, fees, utility reimbursements, and other amounts owed to DPG Investments or White Rose Homes.
Electronic payment services are provided as a convenience. DPG Investments or White Rose Homes may add, remove, restrict, or modify available payment methods to the extent permitted by the applicable Lease and law.
The availability of an electronic payment option does not alter the amount or due date of any obligation under a Lease.
Electronic payments may be processed by an independent third-party payment processor.
By using electronic payment services, you acknowledge that:
Neither DPG Investments nor White Rose Homes is not responsible for the acts or omissions of an independent payment processor or financial institution except to the extent responsibility cannot lawfully be disclaimed.
Initiating or scheduling an electronic payment does not guarantee that the payment will be successfully completed.
A payment will be treated as submitted or received in accordance with the applicable Lease, the procedures disclosed through the Site or payment processor, and applicable law.
You are responsible for initiating payment in sufficient time to satisfy your payment obligations when due and for confirming that a payment has been successfully completed.
A failed, declined, returned, reversed, or otherwise unsuccessful transaction does not discharge the underlying payment obligation.
The Site may permit users to establish recurring or automatic payments (“AutoPay”).
Enrollment in AutoPay is a convenience and does not transfer responsibility for timely payment from the tenant to DPG Investments or White Rose Homes.
You remain responsible for:
A failed AutoPay transaction does not relieve you of an obligation to timely pay rent or other amounts due under your Lease.
You may modify or cancel AutoPay in accordance with the procedures made available through the Site or applicable payment processor. Changes may be subject to reasonable processing periods disclosed at the time of the change.
If an electronic payment is rejected, returned, reversed, dishonored, charged back, or otherwise fails, the underlying obligation remains unpaid.
DPG Investments or White Rose Homes may assess fees or other charges associated with an unsuccessful payment only to the extent authorized by the Lease and applicable law.
DPG Investments or White Rose Homes may restrict electronic payment privileges following unsuccessful or disputed transactions and, to the extent permitted by the Lease and applicable law, may require payment through another method.
Except to the extent otherwise provided by applicable law, acceptance or processing of a payment through the Site does not by itself:
Any effect that acceptance of a particular payment has under applicable law is unaffected by this Section.
If you believe a payment has been processed incorrectly, contact DPG Investments or White Rose Homes promptly at the contact information listed below and, where appropriate, contact the applicable payment processor or financial institution.
Nothing in these Terms limits any nonwaivable rights you may have under applicable banking, electronic-funds-transfer, credit-card, or consumer-protection laws.
The Site may permit tenants to submit routine maintenance and repair requests.
When submitting a maintenance request, you agree to provide reasonably complete and accurate information regarding the condition being reported.
Submission of a request through the Site does not guarantee immediate review, response, repair, or a determination that the requested work is the responsibility of DPG Investments or White Rose Homes.
DPG Investments or White Rose Homes may prioritize requests based on the nature and severity of the condition, health and safety considerations, vendor and parts availability, weather, access to the property, and other relevant circumstances, subject at all times to its obligations under the Lease and applicable law.
THE SITE IS NOT AN EMERGENCY SERVICE AND SHOULD NOT BE RELIED UPON TO REPORT AN EMERGENCY. THE TENANT PORTAL MAY NOT BE MONITORED CONTINUOUSLY.
If there is an immediate threat to life, health, safety, or property, including a fire, suspected gas leak, serious flooding, criminal activity, or other emergency, call 911 or the appropriate emergency service when warranted and follow the emergency procedures provided in your Lease or other instructions provided by DPG Investments or White Rose Homes.
For urgent property-maintenance matters, contact DPG Investments or White Rose Homes using the emergency or after-hours contact method provided in your Lease or tenant materials.
A Portal submission should not be treated as a substitute for any other notice required by your Lease or applicable law.
Submission of a maintenance request may result in DPG Investments or White Rose Homes or its employees, agents, contractors, or vendors contacting you regarding access to the property.
Nothing in these Terms expands or limits any right of entry, notice requirement, or access obligation established by the Lease or applicable law.
Submission of a maintenance request does not constitute a blanket waiver of any notice or consent requirement that otherwise applies to entry into a dwelling unit.
The Site may provide electronic access to copies of leases, amendments, addenda, notices, payment histories, account balances, inspection information, and other records.
These materials are provided for convenience.
DPG Investments and White Rose Homes endeavor to maintain accurate information, but an inadvertent error, omission, delay, or technical problem in information displayed on the Site does not amend the underlying Lease or other original record.
If there is a discrepancy between information displayed on the Site and an executed Lease or other controlling document, the controlling document governs.
You should promptly notify DPG Investments or White Rose Homes if you believe information displayed in your Account is inaccurate.
By providing an email address or telephone number and using the Site, you agree that DPG Investments or White Rose Homes may use electronic means to communicate with you regarding the Site, your Account, an application, a tenancy, maintenance, payments, property-management matters, and other matters relating to your relationship with DPG Investments or White Rose Homes, to the extent permitted by applicable law.
Electronic communications may include email, Site notifications, and, if separately authorized or otherwise permitted by law, text messages.
You are responsible for keeping your contact information current.
This Section does not mean that every notice required by a Lease or applicable law may be delivered electronically. If a Lease or applicable law requires a particular notice to be delivered in a particular manner, these Terms do not eliminate that requirement.
DPG Investments or White Rose Homes may offer the ability to execute applications, leases, addenda, acknowledgments, authorizations, and other documents electronically.
Where you affirmatively agree to conduct a transaction electronically, electronic records and electronic signatures may be used to the extent permitted by applicable law.
Nothing in these Terms requires either you or DPG Investments or White Rose Homes to conduct a transaction electronically when applicable law provides a right to decline to do so.
Any separate electronic-signature platform, consent, disclosure, or procedure presented in connection with a particular document or transaction will also apply to that transaction.
Public portions of the Site may contain photographs, descriptions, floor plans, dimensions, amenities, rental rates, deposit information, availability dates, maps, and other information regarding properties offered for rent.
DPG Investments and White Rose Homes endeavor to keep property listings current and accurate, but listings are subject to change and may contain inadvertent errors or outdated information.
Unless expressly stated otherwise, a listing is an invitation to inquire or apply and is not an offer or promise to lease a property.
Property availability is subject to application requirements, screening criteria, prior rental, withdrawal from the market, execution of a Lease, and other lawful conditions.
Photographs, dimensions, floor plans, and similar materials are illustrative and may not precisely represent a property’s current condition.
DPG Investments and White Rose Homes are committed to complying with applicable federal, state, and local fair-housing laws.
Rental properties will be offered, applications will be considered, and housing services will be provided without discrimination prohibited by applicable law.
Nothing in a property listing or on the Site is intended to indicate a preference, limitation, or discrimination prohibited by law.
You may use the Site only for lawful and authorized purposes.
You may not:
DPG Investments or White Rose Homes may take reasonable measures to investigate suspected misuse, protect the Site and its users, and cooperate with lawful requests from governmental or law-enforcement authorities.
The Site may permit you to submit messages, maintenance requests, applications, photographs, videos, documents, and other information (“User Content”).
You represent that you have the right to submit your User Content and that, to the best of your knowledge, information you submit is accurate and not unlawful.
You retain ownership of User Content you own. By submitting User Content, you grant DPG Investments or White Rose Homes a nonexclusive, royalty-free license to use, reproduce, store, transmit, and disclose the User Content as reasonably necessary to:

The Site and its content, including its design, text, graphics, logos, photographs, and other materials, are owned by DPG Investments or White Rose Homes or used with permission and are protected by applicable intellectual-property laws.
Subject to these Terms, DPG Investments or White Rose Homes grants you a limited, nonexclusive, nontransferable right to access and use the Site for its intended purposes.
You may not reproduce, distribute, modify, publicly display, commercially exploit, or create derivative works from Site content except with DPG Investments or White Rose Homes’ written permission or as otherwise permitted by law.
Collection and use of personal information through the Site are governed by the DPG Investments or White Rose Homes Privacy Policy, as updated from time to time.

No internet transmission or electronic storage system can be guaranteed to be completely secure. You are responsible for using reasonable care when transmitting sensitive information and safeguarding your Account credentials.
The Site may integrate with or link to services operated by third parties, including payment processors, electronic-signature providers, mapping services, screening providers, maintenance vendors, and other service providers.
Third-party services are not controlled by DPG Investments or White Rose Homes and may be subject to separate terms and privacy policies.
To the extent permitted by law, DPG Investments and White Rose Homes are not responsible for the availability, security, privacy practices, content, or independent acts or omissions of third-party services.
A link to or integration with a third-party service does not constitute an endorsement of all content, products, or services offered by that third party.
DPG Investments and White Rose Homes are committed to providing reasonable access to the Site and its services.
If you experience difficulty accessing information or using a Site feature because of a disability, please contact DPG Investments or White Rose Homes using the contact information below so that we may provide reasonable assistance or an alternative means of accessing the relevant information or service.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ITS TECHNOLOGY ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
DPG Investments and White Rose Homes do not warrant that the Site will be uninterrupted, error-free, free from harmful components, compatible with every device or system, or available at all times.
To the fullest extent permitted by law, DPG Investments and White Rose Homes disclaim warranties relating solely to operation of the Site, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and noninfringement.
THIS DISCLAIMER RELATES TO THE SITE AND DOES NOT DISCLAIM OR LIMIT ANY WARRANTY, DUTY, OR OBLIGATION THAT DPG INVESTMENTS OR WHITE ROSE HOMES OWES WITH RESPECT TO A RENTAL PROPERTY UNDER A LEASE OR APPLICABLE LAW.
To the fullest extent permitted by applicable law, DPG Investments and White Rose Homes and their members, managers, employees, agents, contractors, and affiliates shall not be liable for indirect, incidental, special, exemplary, consequential, or punitive damages arising solely from the use of, or inability to use, the Site, including damages arising from Site outages, technical failures, data loss, or failures of independent third-party services.
DPG Investments or White Rose Homes shall not be liable for losses resulting from unauthorized Account access caused by a user’s failure to reasonably safeguard login credentials after the user knew or reasonably should have known those credentials were compromised.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, and nothing in this Section limits any obligation or remedy arising from the condition of a rental property, a Lease, or applicable landlord-tenant law merely because communications concerning that matter occurred through the Site.
To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless DPG Investments and White Rose Homes and their members, managers, employees, agents, and contractors from third-party claims, damages, liabilities, costs, and reasonable attorneys’ fees arising directly from:
This Section does not require a tenant to indemnify DPG Investments or White Rose Homes for DPG Investments or White Rose Homes’ own negligence, willful misconduct, violation of law, or breach of a Lease.
DPG Investments or White Rose Homes may suspend, restrict, or terminate access to the Site or an Account when reasonably necessary to:
Portal access may also end following move-out, termination of a Lease, completion or withdrawal of an application, or transfer of management or ownership of a property.
Suspension or termination of Site access does not terminate or alter rights or obligations under a Lease or applicable law.
DPG Investments or White Rose Homes may modify the Site and may revise these Terms from time to time.
When these Terms are revised, DPG Investments or White Rose Homes will post the updated Terms and revise the Effective Date above. If required by applicable law, DPG Investments or White Rose Homes will provide additional notice or obtain consent before a change becomes effective.
Continued use of the Site after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
No revision to these Terms will retroactively amend an executed Lease unless separately agreed in a manner sufficient to amend that Lease.
These Terms shall be interpreted consistently with applicable federal, state, and local law, including applicable landlord-tenant and consumer-protection laws.
Nothing in these Terms waives a right or remedy that applicable law does not permit a party to waive.
If a provision of these Terms conflicts with a nonwaivable requirement of applicable law, the legal requirement controls.
To the extent permitted by applicable law, DPG Investments and White Rose Homes shall not be liable for interruption or failure of the Site caused by circumstances beyond its reasonable control, including severe weather, natural disasters, utility or telecommunications failures, internet outages, cyberattacks, governmental action, civil disturbance, labor disruption, or failure of an independent service provider.
This Section applies to operation of the Site and does not excuse any obligation concerning a rental property that cannot lawfully be excused.
These Terms and use of the Site are governed by the laws of the State of Oklahoma, without regard to conflict-of-laws principles.
Subject to any mandatory venue requirement imposed by applicable law, an action arising solely from these Terms or use of the Site may be brought in a court of competent jurisdiction in the State of Oklahoma.
Nothing in these Terms alters the jurisdiction or venue applicable to a forcible-entry-and- detainer action, landlord-tenant proceeding, or other claim governed by a Lease or applicable law.
You may not assign your rights to access an Account or the Site to another person without DPG Investments or White Rose Homes’ consent.
DPG Investments or White Rose Homes may transfer its rights and responsibilities relating to the Site in connection with a sale or transfer of property, change in property management, merger, acquisition, restructuring, or other lawful business transaction, subject to applicable law.
A failure to enforce a provision of these Terms on one occasion does not waive the right to enforce that provision or another provision on a later occasion.
A waiver by DPG Investments or White Rose Homes must be in writing to be effective.
If any provision of these Terms is held invalid or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in effect.
These Terms, together with the Privacy Policy and any other Site policy expressly incorporated by reference, constitute the agreement between you and DPG Investments and White Rose Homes concerning use of the Site.
They do not constitute the entire agreement governing a tenancy and do not replace or supersede a Lease.
If these Terms conflict with a Lease concerning the landlord-tenant relationship, the Lease controls. These Terms control with respect to matters relating solely to use and operation of the Site unless applicable law provides otherwise.
Section headings are included for convenience only and do not affect interpretation of these Terms.
Provisions that by their nature should survive termination of Site access shall survive, including provisions concerning intellectual property, User Content licenses, disclaimers, limitations of liability, indemnification, governing law, and rights or obligations accrued before termination.
